Executive Summary

SB 402 extends certain anti-discrimination and civil rights statutes to create special protected classes for sexual orientation and gender identity.

Analysis

SB 402 seeks to create discrimination violations against Christians by prohibiting religious liberty practices of those who live by Biblical principles.  SB 402 would create special protected class for "sexual orientation" and "gender identity". It would empower the Indiana Civil Rights Commission to persecute citizens who disagree with the GLBT agenda. This sort of law is what has led to a plethora of free speech and religious liberty violations around the country. Including the attacks upon Jack Phillips (Masterpiece Cakeshop) in Colorado and Baronnelle Stutzman (Arlene's Flowers) in Washington State.  Those who do not want to celebrate an anti-biblical view of sexuality or gender will have their liberties put in jeopardy.

Conclusion

SB 402 provide a weapon to every GLBT activist in Indiana with which to legally attack anyone with whom they disagree regarding sexuality and gender.  It allows activists to target Christian business owners, non-profits, counselors, non-profits, schools (and more) for government persecution.  As we have seen in other states, when this policy is implemented it is used to silence and punish Christians who dare to follow the Bible. This anti-Christian bigotry most stop.

IFI opposes SB 402.
